1.2- BUYER: The individual or organization that orders the products listed on this invoice and whose information is electronically protected by SSL encryption and confirms the accuracy of the identity information provided.

ARTICLE 2 - SUBJECT

The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the product, which the BUYER ordered electronically from the SELLER's website trimsshop.com, and whose sales price is specified in the order information and invoice, in accordance with the provisions of Law No. 4077 on the Protection of Consumers and the Regulation on the Principles and Procedures for the Implementation of Distance Contracts.

ARTICLE 3 - SUBJECT OF THE AGREEMENT

PRODUCT 3.1 - Type: The type, type, quantity, brand/model, color, and sales price of the products are as indicated on the information cards and shown in the order basket and on the front of the invoice.

3.2 - Payment Method: As specified on the front of the invoice. Open invoices, project purchases, work performed under contract, and purchases by cash on delivery or check are subject to special conditions.

3.3- Interest: On the other hand, since deferred sales are made only with credit cards issued by banks, the BUYER acknowledges, declares, and undertakes to separately verify the relevant interest rates and default interest information with their bank. The provisions regarding interest and default interest will apply within the scope of the credit card agreement between the Bank and the BUYER, in accordance with applicable legislation.

Credit Card Refund Procedure: In cases where the Buyer exercises their right of withdrawal, or if the ordered product cannot be supplied for various reasons, or if the arbitration board decides to refund the amount to the Consumer, if the purchase was made with a credit card and in installments, the credit card refund procedure is as follows:

If the customer's credit card payments are reflected in our accounts in one installment, the bank will refund the customer in one installment. If the payments are reflected in monthly installments, the bank will refund the customer in one installment. Exceptions to this rule are at the bank's discretion. In the event of a return of goods and services purchased with a card, trimsshop.com cannot pay the Customer in cash, in accordance with its agreement with the Bank.

3.4- Delivery Method and Address: Delivery Address: As specified in the order form. Invoice Address: As specified in the order form. Delivery Time: Maximum 30 business days. For orders placed before 3:30 PM, warehouse-stocked products will be shipped the same day, supplier-stocked products will be shipped 24/48 hours, and special import products will be shipped within 30 business days. For products exceeding the maximum delivery time, the order may be put on hold or canceled upon the BUYER's notification. Delivery will be hand-delivered to the BUYER's address specified above via the contracted courier company. Even if the BUYER is not at the address at the time of delivery, the SELLER will be deemed to have fully and completely performed the obligation undertaken. Therefore, any damages arising from the BUYER's late receipt of the product, as well as any expenses incurred due to the product being held by the courier company and/or the return of the cargo to the SELLER, are the responsibility of the BUYER. Shipping Fee: Calculated at the time of shipment and paid by the customer unless otherwise stated.

ARTICLE 4 - GENERAL PROVISIONS

4.1 - The BUYER declares that they have read and are familiar with the basic specifications, sales price, payment method, and preliminary delivery information regarding the contracted product on the trimsshop.com website, and have provided the necessary confirmation electronically.

4.2 - The contracted product will be delivered to the BUYER or the person/entity at the address specified by the BUYER within the period specified in the preliminary information on the website, depending on the distance from the BUYER's residence for each product, provided that it does not exceed the legal 30-day period.

4.3 - If the contracted product is to be delivered to a person/entity other than the BUYER, the SELLER cannot be held responsible if the person/entity refuses to accept the delivery.

4.4 - The SELLER is responsible for ensuring that the contracted product is delivered intact, complete, complies with the specifications specified in the order, and accompanied by any warranty documents and user manuals.

4.5 - For the delivery of the contracted product, a signed copy of this contract must be delivered to the SELLER, and the price must be paid using the BUYER's preferred payment method. If, for any reason, the product price is not paid or is cancelled in the bank's records, the SELLER is deemed to be relieved of its obligation to deliver the product.

4.6 - If, after delivery of the product, the relevant bank or financial institution fails to pay the SELLER the price of the product due to the unauthorized or illegal use of the BUYER's credit card by unauthorized persons, not due to the BUYER's fault,

4.7- Defective or broken products, whether sold with or without a warranty certificate, can be sent to the SELLER to have the necessary repairs carried out by an authorized service within the warranty conditions. In this case, the shipping costs will be covered by the BUYER.

ARTICLE 5 - RIGHT OF WITHDRAWAL BUYER,

The customer has the right to withdraw by rejecting the product within 7 days of its delivery to the customer or the person/entity at the address provided. The price of the product will be refunded to the BUYER within 10 days of the date the consumer's notice of withdrawal reaches the SELLER. The shipping costs of products returned due to the right of withdrawal will be covered by the BUYER. In accordance with the general communiqué of Tax Procedural Law No. 395, in order for returns to be processed, the relevant sections of the invoice we sent you, including the return section, must be completely completed and signed, and returned to us along with the product.

ARTICLE 6 - PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for products that cannot be returned due to their nature, single-use products, copyable software and programs, products that are not resalable after installation or opening of their packaging, products that deteriorate rapidly, or products that have expired. To exercise the right of withdrawal, the product must be unopened, undamaged, and unused. Products that cannot be returned due to their nature cannot be returned unless they are defective or faulty.

ARTICLE 7 - DEFAULT PROVISIONS

Pursuant to the final paragraph of Article 9 of the Regulation on Distance Contracts, if the SELLER, trimsshop.com, is unable to fulfill its contractual obligations on the grounds that the fulfillment of the ordered goods or services has become impossible (in the event of the product not being procured from the supplier at all), it undertakes to notify the consumer of this situation before the expiration of the contractual performance obligation. In this case, trimsshop.com has the right to terminate the contract immediately and undertakes to refund the price of the product ordered by the customer and all documents, if any, that entail debt. If trimsshop.com cannot deliver the contractual product within the specified time due to force majeure, adverse weather conditions preventing transportation, transportation interruptions, natural disasters such as fire, earthquake, flood, or similar events that may prevent trimsshop.com from fulfilling this obligation, the BUYER acknowledges that trimsshop.com has no liability and may exercise one of its rights to cancel the order or postpone the delivery time until the impeding situation is resolved. If the BUYER cancels the order, the amount paid will be refunded to the BUYER within 10 days. For purchases made in installments by credit card, the BUYER accepts the above procedure for refunds to the credit card.

ARTICLE 8 - COLLECTION SHIPMENT (CASH ON DELIVERY) PROVISIONS

8.1- Membership Requirement: To place an order for cash-on-delivery shipments, registration is required. Orders for cash-on-delivery shipments cannot be accepted outside the system or through Express Orders.

8.2- Payment Method: Payment for cash-on-delivery shipments can be made by cash or credit card, depending on the agreement with the courier company. Partial payment or installment payments are not possible for cash-on-delivery shipments.

8.3- Customers cannot benefit from the additional 5% money transfer discount offered for all products for cash-on-delivery shipments. Other promotional discounts for these products apply.

8.4- Confirmation: If necessary, customers can obtain confirmation by phone before shipping for orders placed with the Cash on Delivery option. Therefore, it is the customer's responsibility to verify the accuracy of the contact information entered into the system. Turkish Republic Identification Number (TCID) must be included in orders. If a corporate invoice is requested, the orderer's TRID number must also be entered.

8.5 - The courier company reserves the right to request identification before delivering the order. The customer also has the right to request identification from the courier company before making payment.

8.6 - For orders placed for collection by the courier company for amounts below a certain amount or above a certain amount, a "Collection Service Fee" will be charged separately. This fee does not include the cargo transportation fee.

8.7 - For collection shipments, charges will be assessed and collected for shipments that have been processed, confirmed by phone, departed, or not received. The cost of product supply, arrival, and departure cargo transportation will be requested and collected against an invoice.

8.8 - To place an order using cash on delivery or credit card, you must be at least 18 years of age. The orderer is responsible for the accuracy and validity of the information provided during the order process. If the orderer is a minor or lacks legal capacity, collection will be requested from a legal guardian. In case of cancellation of an order placed in this way, our company retains the right to claim compensation for expenses.

ARTICLE 9 - VALIDITY

This agreement is valid from the moment the order is placed and recorded in the system. If the order is placed, the BUYER is deemed to have accepted all the terms of this agreement.

ARTICLE 10 - COMPETENT COURT

In the implementation of this contract, Consumer Arbitration Committees and Consumer Courts in the place of residence of the BUYER or SELLER (Istanbul) are authorized up to the value declared by the Ministry of Industry and Trade.
